Consideration of Memorandum of Understanding Between the City of Delray Beach and the Delray Chamber Education Fund, Inc.

Background:

Pursuant to the Commission’s direction, staff drafted a Memorandum of Understanding to expand the Bus Shelter Pilot Program wherein City-owned bus shelters are wrapped in order to raise money for public schools located within the City of Delray Beach.  This MOU would be between the City of Delray Beach and the Delray Chamber Education Fund, Inc., (DCEF), a not-for-profit corporation whose mission is to develop, support, and fund a diversity of educational initiatives that help make Delray learning programs and schools among the top tier in south Palm Beach County.

 

The MOU provides a one year term with the option to renew for two additional 1-year terms.  Any sponsorships approved and installed prior to the expiration of the MOU would be permitted to remain after the expiration of the MOU pursuant to the terms of the sponsorship agreement with DCEF.   Each party has responsibilities under the MOU.  Responsibilities specific to DCEF include marketing the Program, managing the design of the wraps, ensuring that proper City documents are executed, and submitting a quarterly report to the City.  In exchange, the City will provide bus shelters for the program and make best efforts to correct any damage or maintenance issues at the bus shelters, as resources permit.  The MOU could be terminated for convenience or for cause.
