Motion to Adopt Resolution No. 155-21 amending the Fiscal Year 2020-21 budget.

Background:

The City Manager’s Department is requesting a budget amendment in the Special Projects Fund (Fund #115) for the Public Art Fund for a Community Mural Project surrounding the Community Grove at Catherine Strong Park. 

 

On March 8, 2019, the City of Delray Beach (City) and Anthony Hernandez/Lola International Inc. (Artist) entered into an agreement for a Community Mural Project surrounding the Community Grove at Catherine Strong Park in the amount of $25,000. Under the terms of the agreement, the City would pay the Artist in two installments with the first installment of $5000.00 due upon execution of the agreement and the second installment due after the culmination of the installation of the public art after the City’s full acceptance and approval and upon receipt of the invoice from the Artist. The Artist completed the project on August 27, 2021 and has provided the City a final invoice in the amount of $20,000.

 

The first payment was made to the Artist on August 23, 2019, in the amount of $5000.00.  The remaining amount of $20,000 was encumbered for final payment when completed. However, the encumbered Purchase Order was not carried forward from Fiscal Year 2020 to Fiscal Year 2021. Therefore, to pay the Artist the second installment of $20,000, Staff is requesting a budget amendment from fund balance in the Public Art Fund in the amount of $20,000.

 

Additionally, at the City Commission Meeting on September 13, 2021, the City Commission authorized the purchase “Shy Dancer” from Mr. Jeff Wyman in the amount of $5000. The funds are available in the Public Art Fund Fund Balance. Therefore, Staff is requesting an additional budget amendment from the Public Art Fund in the amount of $5000 to purchase “Shy Dancer” for a total of $25,000.
