Motion to approve consent letter for the installation of a generator pursuant to the June 6, 2001 lease agreement between the City of Delray Beach, Florida and AT&T Wireless Services of Florida, Inc. now Cingular Wireless, PCS, LLC.

 

Body

Background:

In June 2001, the City entered into a lease agreement with AT&T Wireless Services of Florida, Inc. for space located on the Police communications tower located at the Police Department site, 300 West Atlantic Avenue in Delray Beach.  This lease agreement was subsequently amended in 2007 to extend the term of the contract and amended again in July 2018 to provide for conditions of consent and access.  Now, pursuant to the lease agreement between the City and New Cingular Wireless, PCS, LLC, as successor in interest to AT&T Wireless Services of Florida, Inc., (though still an AT&T company and referred to as AT&T), AT&T through their consultant, MasTec Network Solutions LLC, has requested the City's consent to conduct inspections and to replace/add equipment within the leased area on and about the communications tower. This work, which will include the installation of a concrete pad and generator is completely within the area leased to AT&T and will not interfere with other equipment installed on or about the tower.  The newly installed generator will also not interfere with access to the tower nor any other entity's equipment on or about the tower.
