Background:
Sundy Village West, LLC (“Owner”) is the owner of certain real property located at 22 West Atlantic Avenue in Delray Beach (“Property”). Owner is constructing improvements requiring the relocation of certain power lines for the County’s traffic signal located on the southwest corner of the intersection at Atlantic Avenue and Swinton Avenue. This hold harmless agreement requires Owner to indemnify and hold harmless the City in the event that any decorative pavers are damaged during the construction of the improvements by the County or as a result of any maintenance or future improvements that may be required.
