Consider acceptance of a General Utility Easement Dedication by the owner(s) of 810 Andrews Avenue to the City of Delray Beach.

Background:
The owners have requested the abandonment of a drainage easement (presented for simultaneous consideration) at 810 Andrews Avenue, related to the proposed redevelopment of the property. The abandonment request has been reviewed by Engineering, and it has been determined that the abandonment of the drainage easement will not result in the detriment for the provision of utility services, provided a General Utility Easement (GUE) is recorded for a 10 foot by 10 foot area of land at the northeast corner of the property. This area is located within a portion of the drainage easement proposed for abandonment. The GUE will provide for a continuous utility easement along the east property line.
City Attorney Review:
The General Utility Easement Agreement has been reviewed as to form and legal sufficiency.
