Motion to Approve of Interlocal Agreement Between the City of Delray Beach and the Town of Gulf Stream to Transition Building and Related Permitting and Inspection Services.

Background:

On August 10, 2022, the City provided written notice to the Town of Gulf Stream of its intent to terminate the Interlocal Agreement between the City of Delray Beach and the Town of Gulfstream dated September 30, 2009 (the “Notice”).  Pursuant to the Notice, the ILA for building department and related permitting and inspection services terminates on October 10, 2022.  Understanding that certain applications continue to be processed by the City, the proposed ILA serves to provide a transition for the services currently provided by the City.  While the City has stopped accepting non-emergency permit applications, the City will continue to process active permits and permit application for properties located within the Town that will continue to remain active after October 10th.  In consideration for the City performing these limited services, the Town has agreed to hold harmless and indemnify the City and its employees as well as provide the City with a Certificate of Insurance evidencing all necessary insurance coverage for the City and employees.

 

 

City Attorney Review:

Approved as to form and legal sufficiency.

 

Funding Source/Financial Impact:

The City will continue to receive permit fees for properties located within the Town.

 

Timing of Request:

This request is time sensitive as the current ILA terminates on October 10, 2022.
