Approve the Updated Second Amendment to the Interlocal Agreement (“ILA”) between the City of Delray Beach (“City”) and Delray Beach Community Redevelopment Agency (“CRA”) for funding for Construction/Professional Services within the CRA District for Fiscal Year 2022-2023, in substantially the attached form.

Body
Background:
On December 13, 2022, the City and the CRA entered into an Interlocal Agreement for the Funding of Construction/Professional Services for Fiscal Year 2022-2023. On August 15, 2023, the City and the CRA entered into a First Amendment to the Original Agreement to provide increased funding from the CRA due to increased project costs for the Osceola Park Neighborhood Improvements. The City and the CRA desire to enter into this Second Amendment in order to amend Exhibit “A” to the Original Agreement to provide further adjustments based on actual project costs.

On November 16, 2023, the CRA Board approved the Second Amendment to the Interlocal Agreement reflecting the adjustments to project costs. Subsequently, the City informed the CRA that the CRA funding for the Currie Commons Restroom project should be $0 as the project will carry forward to Fiscal Year 2023-2024. Below is the updated exhibit the is included in the Updated Second Amendment for consideration.
