Review and consider acceptance of a General Utility Easement Agreement between the property owner(s) at 1103 Wallace Drive and the City of Delray Beach.

 

Body

Background:

The applicant has requested the abandonment of a portion of right-of-way (presented for simultaneous consideration as Resolution No. 03-24) at 1043 and 1103 Wallace Drive. One half of the area to be abandoned will be added to 1103 Wallace Drive. The abandonment request has been reviewed by Engineering, and it has been determined that the abandonment will not result in the detriment for the provision of utility services, provided that a General Utility Easement is recorded to an area of land between the properties.  As the abandonment area is between two properties, a portion of the abandonment area is returned to the properties to the north (1043) and to the south (1103).  The subject request relates to 1103 Wallace Drive. 

 

City Attorney Review:

The General Utility Easement Agreement has been reviewed as to form and legal sufficiency.

Timing of Request:

The General Utility Easement Agreement shall be recorded after the right-of-way abandonment.
