RESOLUTION NO. 82-24: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, RECOGNIZING THAT THE CITY OF DELRAY BEACH IS CONSIDERING AMENDMENTS TO THE CITY’S LAND DEVELOPMENT REGULATIONS WITH RESPECT TO IN LIEU OF PARKING REQUESTS; EXTENDING THE PENDING ORDINANCE DOCTRINE PERIOD PREVIOUSLY INVOKED BY THE CITY COMMISSION; RESTATING THAT THE CITY WILL DEFER THE PROCESSING AND APPROVAL OF ALL APPLICATIONS FOR IN LIEU OF PARKING REQUESTS DURING THE PENDENCY OF THE CITY’S CONSIDERATION OF THESE AMENDMENTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.

Background:
This Resolution extends the pending ordinance doctrine, more commonly referred to as a “zoning in progress,” previously adopted by the City Commission on May 2, 2023 and subsequently extended on October 17, 2023 in reference to in lieu of parking requests. This 180-day extension would allow City staff to acquaint the newest members of the City Commission with the proposed changes to the current Land Development Regulations. During the zoning in progress period of 180 days, the City will defer acceptance and processing of applications for these requests until either adoption of new regulations or October 23, 2024, whichever comes first.
