Motion to Adopt the Local Rules of Procedure and Quasi-Judicial Rules of the Delray Beach City Commission.

Background:

These amendments to Article VII, Public Participation in City Government, provide notice to the public that engaging in disruptive behavior could result in removal from the Commission Chambers pursuant to Florida Statute 871.01.  The proposed language takes into account a speaker’s First Amendment Rights while balancing the City’s right to hold an orderly meeting. 

 

The time, place, and manner restrictions contained within the Local Rules are viewpoint neutral and are meant to be enforced consistently and equally to all speakers, in accordance with the United States Constitution and federal and state law.  This recent amendment provides additional safeguards to ensure the Commission’s orderly discharge of their official duties.
