RESOLUTION NO. 56-20: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, RECOGNIZING THAT THE CITY OF DELRAY BEACH IS CONSIDERING AMENDMENTS TO THE CITY’S LAND DEVELOPMENT REGULATIONS (LDR) WITH RESPECT TO MURALS; EXTENDING THE PREVIOUSLY INVOKED ZONING IN PROGRESS DOCTRINE WITH RESPECT TO THE CITY’S LDR’S; PROVIDING THAT DURING THE PENDENCY OF THE CITY’S CONSIDERATION OF THE NEW LDR AMENDMENTS, THE CITY WILL DEFER THE PROCESSING AND APPROVAL OF ALL APPLICATIONS FOR MURALS INCONSISTENT WITH THE LDR’S; AND PROVIDING AN EFFECTIVE DATE.

Background:
This Resolution maintains the City’s invocation of the pending ordinance doctrine as applied to large paintings or drawings affixed to the walls of buildings located in commercially zoned districts, aka murals. City staff will continue to defer its processing of applications for operations related to murals for an additional 180 days. Staff has been reviewing the subject matter and potential Code changes related to same and expects to have an ordinance for the Commission’s consideration in the near future.
