Approve the Revocable Temporary Use Agreement (Agreement) with David Mancini & Sons, Inc. and authorize the Executive Director to execute the Agreement and all related documents.

Background:
David Mancini and Sons Inc. (Mancini) is under Contract with the City of Delray Beach to construct the NE 3rd Avenue Streetscape Improvements Project. This project is funded by the CRA ($1,842,843) and managed by the City Public Works Department. The proposed improvements include well-lighted pedestrian connections to the public parking areas and to area businesses and include water, sewer and drainage upgrades.
Mancini has submitted a request to utilize the East half of CRA-owned parking lot at 362 NE 3rd Avenue (exhibit A) as staging area to store construction equipment during the project construction time frame. The requested dates are from November 21, 2021 to May 20, 2022.
To allow the utilization of the CRA-owned properties and parcels for events, activities and staging area, a Temporary Use Agreement is required. The attached agreement includes provisions concerning the resealing and re-stripping of the entire parking lot, containment of any trash or debris, repairs and maintenance of the premises, length of term, indemnification, and insurance.
At this time, CRA Staff is requesting the CRA Board to approve the Agreement with Mancini, allowing the temporary use as staging area located at 362 NE 3rd Avenue and authorize the CRA Executive Director to execute the Agreement and all related documents.
