Approve the Landscape Maintenance, Corner Clip Easement, General Utility Easement, Easement for Pedestrian Clear Zone and Right of Way Deed for the property located on 95 SW 5th Avenue, Delray Beach, FL 33444, in substantially the attached forms. 

 

Body

Background:

On August 25, 2021, a Class V Site Plan was approved by the Delray Beach Site Plan Review and Appearance Board (SPRAB) for the development of a two (2) story office building at 95 SW 5th Avenue, Delray Beach, FL 33444, a Delray Beach Community Redevelopment Agency (CRA) owned property.

 

As part of the site plan certification process, the City requires the CRA, as the property owner, to enter into the following agreements: Landscape Maintenance, Corner Clip Easement, General Utility Easement, Easement for Pedestrian Clear Zone and Right of Way Deed for the subject property.

 

At this time, the Landscape Maintenance, Corner Clip Easement, General Utility Easement, Easement for Pedestrian Clear Zone and Right of Way Deed for the property located on 95 SW 5th Avenue are before the Board for approval and for the CRA Executive Director to sign all documents for said purpose in substantially the attached form.

 

Attachments: Exhibit A - Landscape Maintenance Agreement; Exhibit B - Corner Clip Easement Agreement; Exhibit C - General Utility Easement Agreement; Exhibit D - Easement for Pedestrian Clear Zone; Exhibit E - Right of Way Deed.
