Amend the terms of the funding agreement and extend the termination date to September 30, 2022.

Background:
At the June 23, 2020, CRA Board Meeting, the CRA Board approved a Site Development Assistance Funding award for Marion Associates, LLC for their improvement project at 131 NW 1st Avenue, within CRA sub-area #3.
A First Amendment to the Funding Agreement was approved by the CRA Board at the September 9, 2021 meeting. At that time, the grantee reported delays due to unforeseen structural issues that later caused delays in the order/delivery of materials not previously planned for.
While the project continues to progress, the grantee continues to experience delays due to supply chain issues. A detailed explanation of the project delays is provided in Exhibit B. An extension is being requested to ensure that the entire project is completed within the parameters of the agreement. The original agreement termination date was August 31, 2021. As the project is moving forward, Staff is requesting the agreement be reinstated and the terms amended to extend the termination date to September 30, 2022.
